Trading company X in Japan received an order for 1 ton of inorganic fibers, which falls under Item 16 of Appended Table 1 of the Export Order, from manufacturer Y in Lebanon.
Upon confirming the intended use, they were informed via email that it would be used for the manufacture of machine guns, which are conventional weapons.
In this case, trading company X meets the usage requirements for the Catch-All Control on conventional weapons, so an export license application is required.

When an application for the Catch-All Control on conventional weapons is required, it is necessary if the goods/technology fall under Item 16 of Appended Table 1 of the Export Order or the Appended Table of the Foreign Exchange Order, and if they are for regions other than those in Appended Table 3 of the Export Order, and meet any of the following conditions:

I. If the destination (provision site) is a region in Appended Table 3-2 of the Export Order (UN arms embargoed countries/regions) and
meets the objective requirements (usage requirements only) or inform requirements of the Catch-All Control on conventional weapons

II. If the destination (provision site) is other than a region in Appended Table 3-2 of the Export Order (UN arms embargoed countries/regions) and
only if it meets the inform requirements

Manufacturer X in Japan plans to export numerically controlled machine tools falling under Item 6 (2) of Appended Table 1 of the Export Order to its subsidiary Y in Singapore every month starting next year.
In this case, it would be good to obtain a General Bulk Export/Service (programs for use) Transaction License.

All regions except those listed in Appended Table 3 of the Export Order. The 27 countries listed in Appended Table 3 of the Export Order are countries that participate in international treaties and the four international regimes regarding export control and strictly implement catch-all controls, so they are exempt from regulation.
Note that regions listed in Appended Table 3 of the Export Order are also exempt from the Catch-All Control on conventional weapons.

A person who intends to engage in the customs brokerage business must obtain permission from the Minister of Finance (Article 3, Paragraph 1 of the Customs Brokerage Act).
A person who has obtained permission may conduct customs brokerage business within the jurisdiction of all customs offices, regardless of the location of the business office where the customs brokerage business is conducted.
Also, when the Minister of Finance grants permission for the customs brokerage business, they shall publicly notify that fact without delay, and issue a license certificate to the person who obtained the permission (Article 3, Paragraph 4 of the Act).
At this time, based on the Registration and License Tax Act, registration and license tax is imposed.
This public notification is made only when permission is granted, and is not made if permission is not granted.

Note that when a lawyer performs customs brokerage business as their professional duty pursuant to the provisions of the Attorney Act, or a patent attorney pursuant to the provisions of the Patent Attorney Act, Article 3, Paragraph 1 of the Customs Brokerage Act (permission for customs brokerage business) does not apply (Article 3, Paragraph 5 of the Act).
