TikTok Subscription Terms of Sale

These TikTok Subscription Terms of Sale ("Terms") govern your participation in subscriptions made available by TikTok USDS Joint Venture LLC ("Subscription Services") and the benefits you may access upon purchasing a subscription in the United States ("Subscription Benefits"). Your purchase of Subscription Services is entirely voluntary.

In these Terms, "TikTok USDS Joint Venture", "we", "us" or "our" refers to TikTok USDS Joint Venture LLC . TikTok USDS Joint Venture works with service providers and business partners, such as BD TikTok USA LLC and affiliates (hereinafter "TT Commerce & Global Services"), and our affiliates, in order to provide certain important functions of the Service+ Courses so that you and other users can use them and enjoy a global experience, including in connection with commercial services and activities.

Please read these Terms carefully before you subscribe to any Subscription Services. If you do not agree to these Terms, please do not subscribe to the Subscription Services. We reserve the right to update these Terms from time to time, and your continued use of the Subscription Services constitutes acceptance of these changes.

These Terms are in addition to any other terms, policies and guidelines that you have agreed to adhere to while using the TikTok Platform ("Platform"), including our Terms of Service, Privacy Policy, Community Guidelines and Virtual Items Policy (the foregoing terms and policies are referred to collectively in these Terms as the "TikTok Terms and Policies"). Capitalized terms used but not defined in these Terms shall have the meaning set out in our Terms of Service or Community Guidelines. In the event of any conflict or inconsistency between these Terms and TikTok Terms and Policies, these Terms shall govern your access and use of the Subscription Services.


SUBSCRIPTION SERVICES ARE INTENDED SOLELY FOR PERSONAL ENTERTAINMENT PURPOSES ONLY. TIKTOK USDS JOINT VENTURE DOES NOT PROVIDE ANY FORM OF ADVICE AND YOU SHOULD NOT SEEK TO RELY ON ANY SUBSCRIPTION SERVICES OR ANY OTHER CONTENT POSTED BY THE CREATOR ASSOCIATED WITH SUBSCRIPTION SERVICES. TIKTOK USDS JOINT VENTURE AND TT COMMERCE & GLOBAL SERVICES AND ITS AND THIER AFFILIATES DO NOT PROVIDE ANY REPRESENTATION OR WARRANTY WITH RESPECT TO ANY PART OF THE SUBSCRIPTION SERVICES.

1. Subscription Services

When you purchase Subscription Services, you will be able to access Subscription Benefits, subject to these Terms. For illustrative purposes only, such Subscription Benefits may include:

a. being able to use the specially-designed stickers in direct message;

b. having access to exclusive content or spaces , like creator chat rooms, that are made available only to his/her subscribers; and

c. personalized shoutouts and other customized perks in accordance with TikTok USDS Joint Venture's policies.

We may change Subscription Services and Subscription Benefits at any time in our sole discretion, including during a billing period. We will notify you of any material changes so you can choose to cancel your subscription before you are committed to the next billing period. Your continued use or renewal of Subscription Services constitutes acceptance of any changes. In no event will we or our affiliates, service providers, and business partners, including TT Commerce & Global Services and its affiliates, and each of their respective officers, directors, employees, agents and advisors be liable for the discontinuation or disabling of Subscription Services or Subscription Benefits.

TikTok sells access to the Subscription Services. TT Commerce & Global Services and its affiliates are solely responsible for any payment or financial obligations in relation to the Subscription Services. Creators can choose which Subscription Benefits to offer to users who purchase a Subscription Service and may create, manage, maintain or make changes to those Subscription Benefits. TikTok USDS Joint Venture and our affiliates, service providers, and business partners, including TT Commerce & Global Services and its affiliates, and each of their respective officers, directors, employees, agents and advisors are not responsible for the content a Creator shares with subscribers or for a creator's failure to create, manage, or maintain Subscription Benefits. Use of the Subscription Services is at your sole discretion.

We will display the total price of the Subscription Services to you at the time of your purchase, and such price is inclusive of service fees charged by us. We reserve the right to change the price of Subscription Services. We will provide you with notice of price changes and they will apply to you no earlier than your next renewal. If you do not agree with any such price change, you should cancel the Subscription Service. After you pay the price displayed on the subscription page on the Platform, you will gain access to the Subscription Services introduced on the subscription page through your TikTok account. You should check and confirm how much the Subscription Services cost before making the payment. You will be able to track your spending on Subscription Services by accessing Settings and Privacy > Balance > Transaction History, which will display how much you have spent on the Subscription Services.

2. Conditions of Subscription

Your access to or use of Subscription Services is at all times subject to TikTok Terms and Policies.

To subscribe to the Subscription Services, you must meet the following conditions:

  • be a registered user of the Platform;
  • reach the age of majority under the laws of your region of residence; and
  • comply with the local applicable laws and TikTok Terms and Policies.

TikTok USDS Joint Venture may choose to deny a subscription purchase at any time at its sole discretion.

3. Subscription Options

Subject to the subscription pricing options, you may be offered one or more subscription types, including, among others:

  • Thirty-day subscription: The subscription period will last for 30 calendar days starting on the date of subscription.
  • Monthly auto-renewal subscription: The subscription period will last for a month starting on the date of subscription and will renew automatically for subsequent monthly periods unless you cancel the subscription.

You can manage your subscriptions in [Privacy and Settings > Subscription]. You can review your current and expired subscriptions and cancel monthly auto-renewal subscriptions on the subscription page.

4. Payment for your subscription to the Subscription Services

You may purchase access to the Subscription Services by using the in-app purchase method via a third-party app store (such as the Apple App Store or the Google Play Store) or other alternative methods provided by TikTok USDS Joint Venture. The terms and conditions of the applicable third-party app store shall apply in relation to your in-app purchase. If you have any questions about purchasing access to the Subscription Services using an in-app payment method via a third-party app store (including if you wish to cancel any purchase that you have made), please contact the relevant third-party app store directly. TikTok USDS Joint Venture may allow additional and/or alternative methods to purchase access to the Subscription Services in the future at its sole and absolute discretion.

5. Unsuccessful subscription to the Subscription Services

If your payment method is declined, your order will be automatically cancelled. Neither TikTok USDS Joint Venture nor our affiliates, service providers, and business partners, including TT Commerce & Global Services and its affiliates, and each of their respective officers, directors, employees, agents and advisors nor the creator shall be responsible for any issues between you and your card issuer, bank or other payment service provider(s) and/or for any losses suffered by you or any other person as a result of any breach or default by these third parties, as the case may be.

6. No payment services

You acknowledge and agree that TikTok USDS Joint Venture does not provide any payment services to you. Any payment services carried out pursuant to these Terms will be provided and conducted by other third-parties and/or affiliates acting on our behalf.

7. Terminated Subscription Services

If a creator terminates or loses access to the Subscription Services feature (for example, if the creator terminates its TikTok account), all corresponding monthly recurring payments, if any, and access to all Subscription Services will be terminated accordingly.

8. Subscription Cancellation

You can cancel your subscription at any time by visiting the benefits page for each community you have joined. If you select an auto-renewal subscription, you may cancel the subscription at any time before the end of the then current billing period and the cancellation will take effect from the start of the next billing period. You will retain your access to the Subscription Services from the time you cancel until the end of the then current monthly period. Once your current billing period has expired, we will remove your access to Subscription Services and Subscription Benefits, including any content or information made available to you in connection with these services and benefits.

9. Refunds

Except as otherwise required in accordance with applicable laws, you will not be entitled to a refund after purchasing access to the Subscription Services.

10. Your rights

Your access to the Subscription Services is strictly for your personal and non-commercial use. This means that you have no right to or title in any of the Subscription Services that you have subscribed to except as otherwise required by the applicable laws of your jurisdiction or expressly stated in these Terms.

Specifically, you can only use the Subscription Services in certain ways and as they are intended to be used. You must not, and must not allow others to:

  • facilitate illegal or harmful activity through the Subscription Services;
  • cause harm to TikTok or others through the Subscription Services;
  • use the Subscription Services in a way that violates prohibitions imposed by the relevant authorities;
  • make copies for sale, transfer, rent, lease or lending of the Subscription Services;
  • create content, products, services or other derivative materials by using any part of the Subscription Services;
  • use or reproduce any part of the Subscription Services (including any trademarks presented in the Subscription Services), except as law expressly allows;
  • make a public performance of the Subscription Services;
  • publicly display the Subscription Services;
  • use Subscription Services for commercial or business purposes or in any way other than your own personal consumption purposes;
  • work around any of the technical limitations of the Subscription Services, or enable functionality that is disabled or prohibited;
  • decompile, extract source code, or reverse engineer the Subscription Services; or
  • transfer or move software, technology, or services (including our software or encryption software) to or from any country in a way that law does not permit.

11. Termination of accommodating access to the Subscription Services

Notwithstanding anything to the contrary as set out in these Terms, for legal, regulatory or business reasons, we reserve the right to stop accommodating access to the Subscription Services to certain categories of users, or in certain countries or regions. We reserve the right to suspend, discontinue, or terminate your access to the Subscription Services at any time entirely at our sole and absolute discretion.

12. Termination of your access rights

We may terminate or suspend your right to access the Subscription Services immediately if we believe you breached these Terms or TikTok Terms and Policies, violated any applicable laws, or for any other reason. If you want to appeal our decision, you may get in touch with us through [Settings and Privacy > Support > Report a Problem].

13. Taxes

TikTok has the right to charge any taxes (including value added taxes or national, state or local sales or use taxes) where required under applicable laws of your jurisdiction. If the subscription fees are subject to taxes in your jurisdiction and you have not paid the applicable taxes to us, then you will be responsible for the payment of such taxes and any related penalties or interest to the relevant tax authority.

14. Indemnity

You agree to defend, indemnify, and hold harmless TikTok USDS Joint Venture and our affiliates, service providers, business partners, including TT Commerce & Global Services and its affiliates, and each of their respective officers, directors, employees, agents and advisors from any and all claims, demands, damages, injunctions, orders, awards, settlements, losses, liabilities, liens, encumbrances, causes of action, of every kind and character, costs (including attorney's fees and other costs of arbitration, litigation, defense, or settlement), and expenses arising out of or relating to your use of the Subscription Services under these Terms and the TikTok Terms and Policies, including a breach of your obligations, representations and warranties under these Terms and the TikTok Terms and Policies. This provision and your indemnification obligations will survive any termination of your relationship with TikTok and the expiration or termination of these Terms and the TikTok Terms and Policies, by either party.
