TikTok Subscription Terms

1. Introduction and who you are contracting with

These TikTok Subscription Terms (the “Subscription Terms”) contain the terms and conditions governing your subscription to certain benefits that enhance your experience of the Platform (the “Subscription”) and, together with the TikTok Terms of Service (“Terms of Service”), serve as an agreement between you (“subscriber”, “you”) and:

(i) For users resident in the European Economic Area, Switzerland or the UK:

TikTok Information Technologies UK Limited (a company registered in England and Wales with registered office Lindsey Street, Barbican, London, EC1A 9HP, United Kingdom and with registered company number 10165711) (“TikTok UK”) and TikTok Technology Limited (a company registered in the Republic of Ireland with its registered office at 10 Earlsfort Terrace, Dublin, D02 T380, Ireland and company number 635755) (“TikTok IRE”) jointly make the Subscription available. However, the TikTok entity that is solely responsible for any payment, financial or tax obligations in relation to Subscriptions is TikTok UK;

(ii) For users resident elsewhere:

TikTok Pte. Ltd. (a company registered in Singapore with address 1 Raffles Quay, #26-10, South Tower, Singapore 04858) (“TikTok ROW”).

TikTok UK, TikTok IRE and TikTok ROW are, together, “TikTok”, “we” and “us” in these Subscription Terms.

You must be at least 18 years old (or, if higher, the age of legal capacity in your country of residence) to purchase a Subscription.

These Subscription Terms are supplemental to the Terms of Service and any other terms and policies applicable in connection with those Terms of Service, which apply to your use of the Platform including, without limitation, the Subscription. In the event of any conflict, these Subscription Terms shall take precedence. Capitalized terms used but not set out or defined in these Subscription Terms shall have the meanings given in the Terms of Service.

You form a contract with us when you confirm that you accept these Subscription Terms. Please read these Subscription Terms carefully before subscribing. If you do not agree to these Subscription Terms, then please do not begin a Subscription.

2. Subscription benefits

The primary benefit of the Subscription is to allow you to use the Platform without being shown paid-for advertising which third parties pay TikTok to include in the Platform (the “Ad-Free Experience”). However, other forms of commercial messages and promotional content are also shown on the Platform and you will still see these, so you acknowledge and agree that the Ad-Free Experience does not mean TikTok prevents you from seeing all forms of commercial or promotional content, but only of advertising that third parties would otherwise pay for TikTok to serve to you. Please note that you may still receive Branded Content (as defined in the Branded Content Policy) or other forms of organic commercial content such as the organic posts of a business.

In addition to the Ad-Free Experience, TikTok may from time to time in its discretion also offer additional content, tools and/or services to Subscription users which are not available to users of the Platform without a Subscription or which may be made available earlier to users with a Subscription (the “Subscription Extras”). Subscription Extras are subject to change in accordance with these Subscription Terms. You acknowledge and agree that: (i) TikTok shall not be obliged to provide you with Subscription Extras; (ii) access to Subscription Extras is not guaranteed; (iii) Subscription Extras may be withdrawn at any time; and (iv) the only benefit TikTok shall be obliged to provide in consideration of your joining the Subscription is the Ad-Free Experience.

3. Conditions of Subscription

Your Subscription and its benefits are at all times subject to the Terms of Service and any other terms and policies applicable in connection with those Terms of Service, which apply to your use of the Platform. Additionally, the following eligibility conditions apply to the Subscription: (i) you must be aged 18 years (or, if higher, the age of legal capacity in your country of residence) or over; (ii) you must, throughout the duration of your Subscription, comply with these Subscription Terms, the Terms of Service and the terms and policies applicable in connection with them (for example, you must not breach the TikTok Community Guidelines); and (iii) you must be a resident of a country where TikTok offers the Subscription.

We reserve our right to refuse a request to begin a new Subscription or, subject to Clause 8 below, to renew a Subscription, where we have a legitimate reason to do so (for example, you must not breach the TikTok Community Guidelines).

4. Subscription Options and Automatic Renewal

You may be offered one or more of the following types of Subscription. The characteristics of the types of Subscription we may make available include:

  • One-Off Subscription: The period for your Subscription will last for 30 days starting on the date you pay for and begin your Subscription.
  • Monthly Auto-Renewal Subscription: The period of your Subscription will last for a month starting on the date you pay for and begin your Subscription and shall renew automatically for consecutive monthly periods until you cancel your Subscription or the Subscription or product is cancelled or terminated in accordance with this agreement.
  • Annual Auto-Renewal Subscription: The period of your Subscription will last for a year starting on the date you pay for and begin your Subscription and shall renew automatically for consecutive annual periods until your cancel your Subscription or the Subscription or product is cancelled or terminated in accordance with this agreement.

Whether your Subscription renews monthly or annually will be determined on the basis of the initial Subscription billing plan you select at the point of purchase.

You can manage your Subscriptions using in-settings tools we may make available.

5. Fees and Payments

The cost of your chosen Subscription option will be made clear to you before you make your Subscription purchase.

If you select an auto-renewing Subscription (such as Monthly-Auto Renewal Subscription or Annual Auto-Renewal Subscription), you authorise TikTok to automatically charge the Subscription fee to your payment method at the start of each Subscription period until your cancellation of your auto-renewing Subscription takes effect or until the Subscription or product is cancelled or terminated in accordance with this agreement.

If your payment method becomes invalid for any reason and/or if we are unable to charge you for your auto-renewing Subscription, we will automatically terminate your Subscription. You will continue to have the Subscription benefits until the end of the period you paid for.

You can Subscribe using the payment methods made available during your Subscription purchase journey. If your choice of payment method involves a third party (e.g., you choose to pay using ‘Apple Pay’), then the applicable terms of the third party payment provider shall apply.

6. Free Period of Access

Your Subscription may start with a free period of access. Free periods of access are available to new subscribers only (one per subscriber), unless we tell you otherwise. The specific duration of any free period of access will be specified at the point of sign-up.

You will be charged the full fees for the Subscription automatically at the end of your free period of access, unless you cancel your Subscription before the expiry of such period.

7. Promotional Offers

We may from time to time offer Subscriptions to you on a promotional basis (for example, without charge or at a discounted rate for a limited period of time) subject to you meeting certain eligibility requirements as determined by us (“Subscription Offer”). Where we do make a Subscription Offer available to you, then:

  • any other limitations or conditions associated with a Subscription Offer will be made available to you when redeeming the Subscription Offer or in other communications from us describing the Subscription Offer;
  • we reserve the right to condition or revoke availability of any such Subscription Offer at any time; and
  • following the expiry of the period of any Subscription Offer that you redeem, you will automatically be moved to the paid Subscription you elected at the point of redeeming the Subscription Offer unless you cancel in accordance with these Subscription Terms. You must therefore remember to cancel your Subscription in accordance with these Subscription Terms before the expiry of the Subscription Offer; otherwise you authorise us or your third party purchase provider to charge your credit card or other designated billing method the full fees for the following billing period(s) until you validly cancel your Subscription or the Subscription or product is cancelled or terminated in accordance with this agreement.

8. Cancellation

If you select an auto-renewing Subscription (such as Monthly-Auto Renewal Subscription or Annual Auto-Renewal Subscription), you have the right to cancel your Subscription at any time before the end of the then current Subscription period. You can cancel anytime using in-settings tools we may make available (or, if you purchase from an app store, that the store makes available). If you cancel part way through a Subscription period we will not issue a refund but you will be able to continue to use the Subscription until the end of the current paid period (except if you cancel in accordance with Clause 9 below or as otherwise provided hereafter, where you will be due a pro-rated refund).

If you live in Israel, then your cancellation will come into effect within no later than three (3) business days and if you cancel part way through a Subscription period, we will issue a refund in proportion to the duration of the Subscription period remaining from the date your cancellation came into effect to the date of the expiry of your current Subscription period.

We reserve the right to immediately suspend, discontinue or terminate your access to the Subscription and provide you with a pro-rated refund for any reason, at our sole discretion, without prior notice or liability to you including where:

  • you violate these Subscription Terms, or we reasonably believe that you are engaged in illegal or fraudulent use of the Subscription;
  • we are required to do so by any competent court of law, regulatory authority, or law enforcement agency or continued provision of the Subscription to you creates possible risk or legal exposure for us;
  • doing so is required for the protection, integrity and/or security of our Platform: orour provision of the Subscription (in whole or in part) to you is no longer viable as determined by us.

9. Withdrawal and Refunds

If you live in:

  • the European Union or in the United Kingdom, you are entitled to request a refund without stating the reason during the 14 days after Subscribing;
  • Israel, you are entitled to request a refund without stating the reason during the 14 days after Subscribing or the 14 days after the date of receipt of a written document detailing the main terms of the transaction, whichever is later;
  • South Africa, you are entitled to request a refund without stating the reason during the 7 days after Subscribing,

(the “Withdrawal Period”) as follows:

  • If you have purchased the Subscription directly from TikTok, you accept that the Subscription will be provided to you immediately by TikTok. In such case, you can request a refund during the Withdrawal Period by emailing us at adcenter@tiktok.com and by stating your request and providing us with transaction information for your purchase. Alternatively, you can also use the model form, we make available to request a refund during the Withdrawal Period.
  • Where you are granted a refund in accordance with the above process, the refund will be prorated. This means that the amount of your refund will be in proportion to the duration of the Subscription period remaining from the date of your cancellation request to the date of the expiry of your current Subscription period. You will not receive a refund (and so you will have to pay) for the proportion of your Subscription period where the Subscription benefits were made available to you before you changed your mind.
  • Refunds in accordance with the above will be issued to your original payment method and may take up to seven (7) business days to be processed, depending on the payment method used. TikTok will not charge you any fees in connection with processing the refund.
  • Where you have made a Subscription through a third party (for example, through ‘Apple App Store’ or ‘Google Play’ app store), you will need to contact that third party if you wish to request a refund.

10. Taxes

Where required pursuant to the applicable laws of your country of residence or of TikTok, TikTok may charge taxes in connection with purchases you make (such as a part of Subscription fees). If your Subscription fees are subject to taxation and you have not yet paid us the amount of taxes, then you will be responsible for the tax amount (plus any penalties or interest) due to the relevant tax authority.

11. Changes to terms and offerings

We may make changes to (or withdraw): (i) the types of Subscriptions we offer; (ii) the price of the Subscriptions; (iii) the payment methods available; (iv) the products including the Ad-Free Experience; (v) the Subscription Extras (which are not mandatory for TikTok to provide); and/or (vi) these Subscription Terms, from time to time where we deem it necessary to do so (for example, for business or operational reasons or to reflect changes to our business needs or the needs of our customers). If we do so, we will provide you with reasonable prior notice and you can cancel your Subscription before such changes come into effect if you wish (and where applicable we will provide you with a pro-rated refund).

12. Conformity with Subscription Terms

If you live in the United Kingdom or the European Economic Area, consumer laws provide you with a guarantee regarding the benefits of the Subscription (i.e., for the Ad-Free Experience benefit). TikTok will be liable to you for a lack of conformity you discover within two years of us providing the subscription benefits to you. Your national laws may provide for an even longer guarantee.

We will provide your Subscription benefits to you in conformity with these Subscription Terms. If you notify us of a non-conformity, we will review and seek to bring your Subscription benefits into conformity within a reasonable time from your notification. If this occurs, you may be entitled to a reduction in the cost of your Subscription and/or to a refund for the period of your Subscription that you paid for and during which the benefits were not in conformity with these Subscription Terms.
