From 2022/10/01, personal imports of counterfeit goods will also be subject to customs seizure
You may sometimes purchase items for personal use from e-commerce sites on the internet.
In such cases, if the seller of the purchased item is a foreign business, the item purchased may be imported into Japan from abroad (since it is cross-border transport, it counts as an import).
If the items imported in this way do not violate intellectual property laws, there is no problem, but there are cases where they do violate such laws. Specific examples of items that violate intellectual property laws include counterfeit goods of famous brands and dead copy products.
Previously, there was no crackdown on counterfeit goods or dead copy products intended for personal use. However, due to the 2021 amendments to the Trademark Act and the Design Act, acts such as overseas businesses sending counterfeit goods into the country were deemed infringements of trademark rights and design rights. Furthermore, in line with this, due to the amendment of the Customs Act, counterfeit goods and dead copy products became subject to border enforcement by customs.
