License-Free Radio in Hong Kong
History, standards, operational restrictions, and the potential for digitalization of SRPR for CB (27MHz), SRPR (409MHz), and LPD433 (433MHz band SRD)
To start with the conclusion, the core of license-free two-way radio for the general public in Hong Kong is the 409MHz band SRPR and the 27MHz band CB.[1][2] It can be confirmed from official documents that the 409MHz band SRPR was institutionalized as license-free (licensing exemption) for the general public in 2003.[2][6] The 27MHz band CB was opened to the general public under a class license system in 2006.[3][6] 27MHz CB was institutionalized at least by 2003 for use on fishing vessels but the year the system began (the year of first appearance) is unknown in primary sources.[13] The official reason for the prohibition of indoor transmission for CB is to avoid interference with cable television reception.[6] The 433MHz band (HKCA 1061, 10mW e.r.p.) is recognized in the system as an SRD but the general availability of LPD433-type voice transceivers is unknown in the official documents checked.[1][7][14] In mainland China, the digitalization of walkie-talkies is being promoted according to Guowuban [2025] No. 1 and official interpretations but the addition of digital modulation to the Hong Kong 409MHz SRPR cannot be confirmed in current Hong Kong official documents (unknown).[4][5][10][11] Hong Kong's 409MHz SRPR cannot be used for VoIP gateway purposes by connecting to telephone lines/the internet within the scope of the license-free system (at least, legality cannot be confirmed). Given the conditions of the license exemption system (non-use for providing public telecommunications services) and the equipment assumptions of HKCA 1044 (short-range voice SRPR), it is unsuitable for VoIP Gateway use as seen in Japan's Specified Low Power Radio.[4][5][9][12]
Introduction
The "license-free" radios that the general public can use in Hong Kong are institutionalized under a different classification system than Japan's (Specified Low Power, Citizens Radio, etc.). In the current general guidance from the OFCA (Office of the Communications Authority), the two-way walkie-talkies shown are mainly 409MHz portable radio (SRPR) and 27MHz CB radio, while the 433MHz band is treated as a separate category as a Generic Short Range Device (SRD).[1][2]
In this paper, we will organize the following based on Hong Kong's public primary sources (OFCA/CA, former OFTA/TA, and Hong Kong government publications).
History and background of CB (27MHz), SRPR (409MHz), and 433MHz band SRD (the relationship with so-called LPD433)
Standards for each system (frequency, modulation, output)
Operational restrictions (especially the prohibition of indoor transmission and fixed stations for CB, and the handling of SRPR telephone line/internet connections)
Possibility of Hong Kong SRPR digitalization based on a comparison with the PRS409 system revision in mainland China (Guowuban [2025] No. 1)
The stance of this paper is consistently one of primary source fundamentalism, which is to describe only verifiable facts and mark unknown points as "unknown".
1. The "license-free" institutional framework in Hong Kong
Even if something is "license-free" in Hong Kong, there are at least two paths under the legal system.
1.1 Class Licence
A class license is a system where one is automatically treated as a licensee by meeting the class license conditions without having to perform individual applications or registrations. CB (27MHz) is organized under this framework.[3]
1.2 Exemption from Licensing
The other is licensing exemption based on the Telecommunications (Telecommunications Apparatus) (Exemption from Licensing) Order (Cap.106Z). OFCA I 402 (2025 edition) lists which technical specifications (HKCA standards) of equipment are subject to licensing exemption.[4] 409MHz SRPR is organized under this framework.[4][5]
Even in OFCA's general guidance, 409MHz portable radios are clearly explained as "Exempted from licensing," and 27MHz CB is explained as "Class Licence for Citizens Band Radio Station."[1]
2. 409MHz band SRPR (Short-Range Portable Radio)
2.1 Timing of opening to the general public
Regarding 409MHz band SRPR, the Hong Kong Government News (January 20, 2006) clearly states that OFTA first opened the 409.74–410 MHz band to the general public in 2003.[6] OFCA's information leaflet also explains that "since 2003, those using 409 MHz portable radios have been exempt from holding a licence."[2]
Therefore, the license exemption for the 409MHz band SRPR for the general public can be summarized as 2003.[2][6]
2.2 Background of Institutionalization (Within Confirmable Scope)
Background explanations available in official documents are limited, but at least the following can be confirmed.
Hong Kong Government News (2006) mentions that 409MHz band walkie-talkies became popular for daily communication.[6]
In OFCA/government guidance, 409MHz band walkie-talkies are described as being for small-scale, short-range use and are introduced as a means of communication within groups during activities such as hiking.[1][2]
On the other hand, primary source policy documents detailing the reasons for the introduction of the system in 2003 (such as the text of consultation documents at the time of publication) have not been sufficiently identified within the scope of this confirmation. Therefore, asserting detailed background information should be avoided (unknown).
2.3 Technical Standards (HKTA/HKCA 1044)
The technical specifications for the 409MHz band SRPR are defined in HKTA 1044 Issue 1 (Feb 2003) (organized as HKCA 1044 in the current system).[5] The main specifications are as follows.[5]
Frequency: 409.7500–409.9875 MHz (20 channels)
Channel spacing: 12.5 kHz
Modulation method (document notation): FM (frequency modulation) for voice communication
Maximum output: 500 mW e.r.p.
Antenna: Design requirements that effectively make it non-replaceable
Interference conditions: no-interference / no-protection
In OFCA's general guidance, 409MHz portable radios are summarized as "20 designated channels in the 409.74–410 MHz band" and "500mW e.r.p.".[1]
2.4 Current Status: Can the addition of digital modulation be confirmed?
To conclude, it cannot be confirmed at this time that digital modulation has been added to Hong Kong's 409MHz SRPR (HKCA/HKTA 1044) (unknown).[4][5][8]
The grounds are as follows.
In the OFCA HKCA standard list, the specification for 409MHz SRPR continues to be organized as HKCA 1044.[8]
OFCA I 402 (2025 edition) also references HKCA 1044 as a license-exempt specification.[4]
The text of HKTA 1044 assumes FM voice and does not include any mention of adding digital modulation. [5]
Therefore, regarding Hong Kong, nothing more than a 'future possibility' can be stated.
3. Comparison with the PRS409 system revision in mainland China (Guowuban [2025] No. 1)
3.1 What has changed (mainland China)
In mainland China, the National Radio Office's Guowuban [2025] No. 1 (promulgated in February 2025, effective March 1, 2025) has reorganized the frequency usage management and equipment technical requirements for 150MHz/400MHz band transceivers. [10] The text of the notification plans for
20/40 co-frequency simplex channels (12.5kHz / 6.25kHz) in the 409.75–409.99MHz band for public walkie-talkies (equivalent to PRS409), with technical requirements structured as defined in the attachment. [10]
3.2 How to refer to the 'addition of digital modulation'
The official interpretation document from the mainland Chinese side (Radio Administration of the Ministry of Industry and Information Technology) explicitly states the background of this revision as “promoting the ‘analog-to-digital’ transition process for walkie-talkies”. [11] For this reason,
it is possible to state, based on official documents, that the system revision for the PRS409 system in mainland China is moving in the direction of promoting digitalization. [10][11]
3.3 Implications for Hong Kong (though not definitive)
The progress of PRS409 digitalization in mainland China is important for comparison when considering the future of Hong Kong's 409MHz SRPR. However, as there is no official document indicating a system revision in Hong Kong, it cannot be written that 'it will be added in Hong Kong soon'. [4][8] The appropriate expression for this article is as follows.
While the promotion of digitalization for the PRS409-equivalent system has been officially indicated in mainland China, the addition of digital modulation to the Hong Kong 409MHz SRPR cannot be confirmed in current official Hong Kong documents.
4. 27MHz band CB (Citizens Band Radio)
4.1 Opening to the general public (2006)
According to Hong Kong Government News (January 20, 2006), the Telecommunications Authority opened the 26.96–27.42 MHz band CB to the general public under a class license system. [6] This allowed users to utilize it without individual registration or license fees. [3][6]
OFCA's information leaflet also describes both 409MHz and 27MHz CB as "public use" walkie-talkies. [2]
4.2 Background: Mention of 27MHz band propagation characteristics
In the 2005 Hong Kong Government News (at the start of the consultation), one of the reasons for introducing 27MHz band CB was stated as the expectation of good coverage in suburban, country park, and rural areas due to its propagation characteristics. [15]
However, it cannot be immediately concluded from this point that "the primary purpose was to complement 409MHz." Within the scope of confirming Hong Kong Government News (2005, 2006), there is no such explicit statement. [6][15]
4.3 Before opening: CB for fishing vessel use
Before being opened to the general public, 27MHz CB was at least institutionalized for use on fishing vessels as can be confirmed in HKTA 1022 Issue 3 (Feb 2003). [13] The specification clearly states in both the title and the text
“27MHz Citizen Band (CB) Radio Transceivers for Use On-board Fishing Vessels”. [13]
On the other hand, the year the system for fishing vessel use began (the year of first appearance) cannot be determined (is unknown) from the primary sources confirmed this time. This is because HKTA 1022 Issue 3 is a revised version and does not directly indicate the year the system was established. [13]
5. Operational Restrictions (CB and 409MHz SRPR)
5.1 Restrictions under the CB Class Licence
The CB Class Licence (2006) stipulates two important restrictions for general users. [3]
Prohibition of indoor transmission (reception is permitted)
Prohibition of operation at fixed locations (including fixed station operation connected to indoor or outdoor antennas)
What is important is that these are written in the provisions as separate restrictions. [3] Therefore, "prohibition of indoor operation" and "prohibition of fixed stations" are not synonymous; for example, transmitting from indoors with a handheld radio can violate the indoor transmission prohibition even if it is not a fixed station.
5.2 Reasons for the CB indoor transmission prohibition (official explanation)
Hong Kong Government News (2006) explicitly states avoidance of interference with cable television reception as the reason for the CB indoor transmission prohibition. [6] This point is extremely important in interpreting the intent of the system, and it is more faithful to the primary source to understand it as
specific avoidance of cable TV reception interference rather than the abstract expression of "general interference countermeasures." [6]
5.3 Organization regarding 409MHz SRPR telephone line/internet connection (VoIP Gateway) [Addendum]
The 409MHz band SRPR is organized in Hong Kong as "short-range portable radio equipment (voice FM)" under the framework of Cap. 106Z (Exemption from Licensing Order) and HKCA/HKTA 1044. [4][5] OFCA I 402 explains license-exempt radio equipment (including short-range walkie-talkies) and CPE (customer premises equipment) connected to public fixed telecommunications networks as separate categories, indicating that the latter has a different set of technical specifications (HKCA 2xxx series). [4]
Furthermore, in the legislative structure of Cap. 106Z (including provisions cited in Legislative Council documents), a condition for license exemption is that the equipment shall not be used for the provision of public telecommunications services. [12]
For this reason, it is appropriate to conclude that at least connecting 409MHz SRPR to telephone lines/the internet for relay or gateway purposes while remaining license-exempt, and operating it as part of a public communication service, is outside the scope of the license exemption system. [4][12] Furthermore, HKTA 1044 itself defines SRPR as voice FM short-range portable radio and is not a specification premised on IP network integration functions. [5]
Therefore, regarding usage similar to the VoIP Gateway (IP network-connected relay) seen in Japan's specified low-power radio, it is safe to describe it as **not permitted for use within the scope of Hong Kong's "license-free" system for 409MHz SRPR (at the very least, its legality cannot be confirmed)**. [4][5][12]
6. 433MHz band SRD (relationship with so-called LPD433)
6.1 What can be confirmed in the Hong Kong system is the "433MHz band SRD"
In Hong Kong, what OFCA indicates to the public regarding the 433MHz band is the **Generic Short Range Device (e.g., remote car key)**. [1][14] The system conditions based on the SRD Class Licence (2018) and HKTA/HKCA 1061 are as follows. [7][14]
Frequency band: 433.00–434.79 MHz
Maximum output: 10mW e.r.p.
Technical specifications: HKCA 1061 (formerly HKTA 1061)
6.2 Can the permissibility of LPD433-type voice transceivers be confirmed?
Here, it is necessary to distinguish between institutional theory and practical application.
What can be confirmed as institutional theory: The 433MHz band SRD (HKCA 1061, 10mW e.r.p.) is permitted in Hong Kong. [7][14]
What cannot be confirmed: Whether European LPD433-type voice transceivers are explicitly permitted as general-purpose voice radios in Hong Kong. [1][7][14]
In OFCA's general-purpose walkie-talkie guide, 409MHz/27MHz are explicitly stated as two-way radios for the general public, while 433MHz is guided separately as an SRD. [1][2] Therefore, as far as current official documents are concerned, the following organization is appropriate.
In Hong Kong, the 433MHz band SRD is institutionally permitted, but the usability of LPD433-type voice transceivers cannot be determined from the official documents checked (unknown).
7. Standard Comparison (Scope confirmable under Hong Kong regulations)
7.1 27MHz CB (General Class License)

7.3 433MHz Band SRD (Generic SRD)
Frequency: 433.00–434.79 MHz [1][7][14]
Output: 10mW e.r.p. or less [1][7][14]
Modulation: HKTA/HKCA 1061 is a general SRD performance specification, and it is unclear whether LPD433-type voice use is explicitly permitted [14]
*Note: Hong Kong technical specification documents sometimes use modulation method notation such as FM/AM/PM/SSB rather than ITU emission designators (e.g., F3E, etc.). Therefore, when strictly asking for the "emission designator (symbol)," it may be necessary to organize it as "unknown" based on primary sources. [5][16]
8. Summary (Current Organization)
The findings confirmed in this report are summarized as follows.
The 409MHz SRPR was institutionalized in 2003 as license-free (license-exempt) for the general public. [2][6]
27MHz CB was opened to the general public in 2006 under a class license system. [3][6]
27MHz CB had been institutionalized for fishing boat installation at least by 2003, but the year the system began is unknown based on primary sources. [13]
The prohibition of indoor CB transmission is officially stated as being to avoid interference with cable television reception. [6]
The 433MHz band SRD (HKCA 1061, 10mW e.r.p.) is permitted under the system, but the general availability of LPD433-type voice transceivers is unknown based on official documents. [1][7][14]
In mainland China, the digitization of walkie-talkies is being promoted according to State Radio Office [2025] No. 1 and its official interpretation, but the addition of digital modulation to the Hong Kong 409MHz SRPR cannot be confirmed in official Hong Kong documents at this time (unknown).[4][5][10][11]
It cannot be confirmed that Hong Kong's 409MHz SRPR can be used for telephone line/internet-connected VoIP Gateway purposes within the scope of the license-exempt system, and it is safer to treat it as prohibited under the system.[4][5][12]
While Hong Kong's license-free radio system appears relatively straightforward in practice, institutionally, "class licenses" and "license exemptions" coexist, and there are areas, such as the 433MHz band, where **the existence of a usable band does not align with being explicitly designated for general-purpose voice transceivers**.
Therefore, when discussing future institutional changes (especially the digitization of 409MHz or the clarification of 433MHz voice usage), it is necessary to continuously monitor HKCA specification revisions, OFCA announcements, and legal updates on the Hong Kong side.
Limitations in Research (Clarification of Unknowns)
This article relies on publicly available primary sources from Hong Kong, and the following points remain unknown at this time.
