In light of this situation, we have decided to indicate the basic approach and points to note regarding the implementation of safety and health education, etc., via e-learning, etc., as follows.
Note that with this notification, the Special Education Notification is hereby abolished.

1. Basic Approach

In order to prevent industrial accidents, it is extremely important to appropriately implement necessary safety and health education, etc., for workers starting work. Therefore, the Act stipulates that safety and health education should be conducted not only when newly hiring workers but also when changing work content. It also stipulates that special education should be conducted for those engaged in dangerous or harmful work, and that safety and health education, etc., should be conducted for on-site supervisors such as foremen, as well as other safety and health personnel at workplaces.

With the rapid advancement of digital technology in recent years, the need for implementing safety and health education, etc., via e-learning, etc., is increasing. However, even when conducting safety and health education, etc., via e-learning, etc., in order to ensure educational effects equivalent to face-to-face methods, those implementing safety and health education, etc., must pay attention to the items listed in 2 below.

2. Points to Note When Conducting Safety and Health Education, etc., via E-Learning, etc.

Even when conducting safety and health education, etc., via e-learning, etc., it is necessary to fulfill the scope of statutory subjects, education hours, and instructor requirements, use necessary teaching materials such as textbooks, and implement the education while paying attention to the following.Note that the requirements to be met for each individual education program have been compiled in the attached table, so please refer to it as appropriate.

(1) Safety and health education, etc., other than skill training under Article 76, Paragraph 1 of the Act (hereinafter referred to as "skill training"), health engineering health manager training conducted by a person registered by the Director of the Prefectural Labour Bureau as per item 1 of the Health Engineering Health Manager License section of the Appended Table 4 of the Ordinance on Industrial Safety and Health (Ordinance of the Ministry of Labour No. 32 of 1972) (hereinafter referred to as "health engineering health manager training"), building asbestos-containing building material surveyor training under Article 2, Paragraph 2 of the Regulations for Registration of Building Asbestos-Containing Building Material Surveyor Training (Public Notice of the Ministry of Health, Labour and Welfare, Ministry of Land, Infrastructure, Transport and Tourism, and Ministry of the Environment No. 1 of 2018) (hereinafter referred to as "building asbestos-containing building material surveyor training"), and analysis and survey training based on persons specified by the Minister of Health, Labour and Welfare, etc., pursuant to Article 3, Paragraph 6 of the Ordinance on Prevention of Asbestos Hazards (Public Notice of the Ministry of Health, Labour and Welfare No. 277 of 2020) (hereinafter referred to as "analysis and survey training").

A: The person conducting the education must ensure the fact that the trainee has taken the course and that the education time spent browsing/viewing teaching materials, etc., is equal to or greater than the education time stipulated by laws and regulations. Specifically, there are the following confirmation methods:
(A) A method where trainees are not gathered in one place, but rather, for example, using video conferencing tools, etc., the instructor conducts the education while confirming the attendance status in real-time.
(B) A method where the person conducting the education confirms the attendance status based on video playback records or computer operation records, etc., for the video teaching materials or website videos, etc., used.
(C) In addition to (A) and (B) above, a method by which the person conducting the education can reasonably prove the education time.

B: The instructors appearing in the video teaching materials or website videos, etc., as well as the persons who create and supervise such video teaching materials or website videos, etc., must all have sufficient knowledge or experience regarding the relevant training.

C: Establish a system to accept and answer questions from trainees.

D: For items that require practical training or on-site training, conduct them face-to-face in the same location as the instructor.

(2) Skill training, health engineering health manager training, building asbestos-containing building material surveyor training, and analysis and survey training

A: Regarding skill training, in order for the person managing the operations stipulated in Article 77, Paragraph 2, Item 3 of the Act to grasp the implementation status of the skill training, it must be conducted by gathering at a venue set by the registered training institution, and the completion examination must be conducted face-to-face. In addition, interactivity must be ensured so that the instructor can appropriately respond to questions from trainees during the lecture.

B: Regarding health engineering health manager training, in order for the person managing the operations of health engineering health manager training stipulated in Article 1-2-2-2, Paragraph 1, Item 3 of the Ministerial Ordinance on Registration and Designation Related to the Industrial Safety and Health Act and Orders Based Thereon (Ordinance of the Ministry of Labour No. 44 of 1972; hereinafter referred to as the "Registration Ordinance") to grasp the implementation status of the health engineering health manager training, it must be conducted by gathering at a venue set by the registered health engineering health manager training institution, and the completion examination must be conducted face-to-face. In addition, interactivity must be ensured so that the instructor can appropriately respond to questions from trainees during the lecture.

C: Regarding building asbestos-containing building material surveyor training, in order for the person managing the building asbestos-containing building material surveyor training affairs stipulated in Article 5, Paragraph 1, Item 6 of the Regulations for Registration of Building Asbestos-Containing Building Material Surveyor Training to grasp the implementation status of the training, it must be conducted by gathering at a venue set by the training implementation institution, and the written and oral completion examinations must be conducted face-to-face.
In addition, interactivity must be ensured so that the instructor can appropriately respond to questions from trainees during the lecture.

D: Regarding analysis and survey training, in order for the analysis and survey training implementation institution to grasp the implementation status of the training, it must be conducted by gathering at a venue set by the analysis and survey training implementation institution, and the written and oral completion examinations must be conducted face-to-face. In addition, interactivity must be ensured so that the instructor can appropriately respond to questions from trainees during the lecture.
