Are pharmaceutical companies immune from lawsuits regarding vaccine reactions?

Answer

Mostly yes. Pharmaceutical companies are exempt from legal challenges related to side effects from COVID-19 vaccines.However, this is not total immunity.If a company demonstrates 'willful misconduct' in the manufacturing of the vaccine, they can be sued.

While serious reactions are extremely rare, those who suffer serious complications can petition for payment from an established fund.

On social media, many posts have appeared claiming that pharmaceutical companies are immune from lawsuits regarding their new COVID-19 vaccines. Some use this claim to argue that the new vaccines may not be safe.

"Pharmaceutical companies are immune from vaccine lawsuits," one person wrote on Twitter. "The risk and liability for serious side effects or death are all pushed onto the individual receiving the shot."

To find the truth, the Verify team spoke to two leaders in this field. Peter Meyers, Professor Emeritus at George Washington University Law School, said the claim is mostly true.

"If you just have a side effect or get sick as a result of the vaccination, you cannot sue."

Professor Lawrence O. Gostin of Georgetown University agrees.

" They would be immune if there were unforeseen safety issues," he said.

However, both experts emphasize that this is not total immunity. If there was willful misconduct, the company could still be sued."

"They cannot mislead," Gostin said. "They cannot deceive, commit fraud, or hide information."

The basis for this partial immunity is the 'Public Readiness and Emergency Preparedness' Act, known as the PREP Act. This law was originally created in 2005 to protect pharmaceutical companies from liability.

In February, HHS Secretary Alex Azar invoked the PREP Act again to facilitate the production of COVID-19 vaccines. Approved vaccines are protected from lawsuits under the PREP Act until 2024.

The PREP Act also created a fund called the Countermeasures Injury Compensation Program, or CICP. This fund provides benefits to people who claim to have been injured by vaccines approved for emergency use.

"You file a claim for compensation. For lost income. You can also file for medical expenses."

It is currently unclear how many claimants have successfully received compensation for injuries caused by COVID-19 vaccines.

Gostin emphasized that this liability protection is not absolute.

"Social media talks as if vaccine companies have received a 'get out of jail free' card, but that is a complete misunderstanding," he says. "That is not the case."If they engage in fraudulent or negligent behavior, they can absolutely be sued, and they should be."
